نړیوالې ټولنې، ملګرو ملتونو او په هاګ کې د جرمونو نړیوالې محکمې ته

محترمو ښاغلو او آغلو

د پاکستاني هوایی بریدونو له امله د ژورې اندېښنې او خپګان په څرګندولو سره، موږ له نړیوالې ټولنې، ملګرو ملتونو او د هالینډ په هاګ کې له نړیوالې جنايي محکمې څخه غوښتنه کوو چی د دغه پیښو او جنګی جنایتونو په هکله غور وکړی

د موجودو راپورونو له مخې، د ۲۰۲۶ کال د سپټمبر د ۲۱مې نیټی د شپې په ترڅ کې د افغانستان پر خاوره په کونړ او پکتیکا ولایتونو  کی د پاکستان له خوا یو ځل بیا بمباری وسول، چی په پایله کی یی د کونړ ولایت د نورګل په ولسوالۍ کې درې ملکي وګړي ووژل سول او څلور نور کسان  ټپیان سول. د پیښی په قربانیانو کی ښځې هم شاملې دي. د پکتیکا ولایت د برمل ولسوالۍ په سیمه کې یوه استوګنیزه ودانۍ او یو دوکان ویجاړ سوي دي.

موږ پر ملکي وګړو او ملکي تاسیساتو دغه بزدلانه برید په سختو ټکو غندو او د دغو پېښو د خپلواکو، شفافو او هر اړخیزو تحقیقاتو غوښتنه کوو. هغه کسان چې د دغو جنګي جرمونو مسؤول دي، باید محاکمه سی او د خپلو اعمالو سزا وویني

د موجودو راپورونو له مخې، پاکستان تر اوسه لږ تر لږه ۱۴ ځله د افغانستان له هوايي حریم څخه سرغړونه کړې ده او د افغانستان پر خاوره یې پراخ هوايي بریدونه ترسره کړي دي. سربېره پر دې، د تېرو څو لسیزو په ترڅ کې د پاکستان پوځ د افغانستان پر خاوره له ۷۰۰ څخه زیات سرحدي بریدونه ترسره کړي، چې پکښې یې له نورو وسلو سربېره جنګي الوتکې، بې‌پیلوټه الوتکې، توغندي، هاوانونه او توپونه کارولې دی

په پورته یادو سوو بریدونو کې ګڼ شمېر کورونه، ښوونځي، پوهنتونونه، روغتونونه، دوکانونه، کرنیزې سیمې او نور ملکي تاسیسات ویجاړ یا زیانمن سوي دي. ګڼ شمېر بې‌ګناه انسانانو، چې ماشومان، ښځې، سپین‌ږیري، سپین سری، امیندواره ښځې او حتی څاروي هم پکښې شامل دي، خپل ژوند له لاسه ورکړی یا ټپیان سوي دي. ډېر بریدونه د شپې ترسره سوي دی، هغه مهال چې د پیښی قربانیان د خوب په حالت کی وه. همدارنګه ښځې د ورځنیو کارونو لکه پخلي او جامو مینځلو پر مهال وژل سوې یا ټپیانې سوې دی، او ماشومان د لوبو پر مهال د دغو بریدونو قرباني سوي دي. د پاکستان دجنایتکاره پوځ پرله‌پسې بریدونو خلک له بېرې او ناامنۍ سره مخ کړي دي. ګڼې کورنۍ اړې سوې چې خپل کورونه پرېږدي او شپی دباندې، ځینی وختونه تر باران لاندې تېری کړي

موږ په کلکه په دې نیوکه کوو چې نړیوالی ټولنی - د ملګرو ملتونو او نړیوالې جنایي محکمې په ګډون - تر اوسه د نړیوال قانون د دغو جدي سرغړونو پر وړاندې لازم غبرګون نه دی ښودلی او په دی هکله یې سترګې پټې کړې دي.

د پخوانۍ یوګوسلاویا لپاره نړیوالې جنايي محکمې (آی سی ټی وای) د بوسنیایي سربازانو مشران رادوان کارادزیچ او جنرال راتکو ملادیچ د جنګي جرمونو په تور محکوم کړل. همدارنګه، په هاګ کې د کوزوو ځانګړی محکمی د کوزوو پخوانی ولسمشر هاشم تاچي د جنګي جرمونو په تور محکوم کړی دی. سربېره پر دې، په افریقايي شخړو کې د ترسره سوو جنګي جرمونو له امله څو کسان د نړیوالو محکمو پر وړاندې  محاکمه سوي دي.

دغه وضعیت ته په کتلو سره، موږ پوښتنه کوو چې ولې تر اوسه پاکستاني جنرالان او دیکتاتوران د جرمونو نړیوالې محکمې له خوا د جنګي مجرمینو په توګه نه دي محاکمه سوي؟ سره له دې چې دغه کسان له څو لسیزو راهیسې د ډیورنډ کرښې په دواړو غاړو کې د میلیونونو بې‌ګناه افغانانو د کړاوونو او مړینې مسؤول دي، خو تر نن ورځې پورې له دوی سره حساب نه دی سوی. په داسي حال کې چی هېڅ انسان میلیونونه مېږيان نه وژني — خو پاکستاني جنګي مجرمینو د ډیورنډ کرښې په دواړو غاړو کې د میلیونونو بې‌ګناه افغانانو ژوند له منځه وړی دی. د دغو جرمونو کچه او وحشت بې‌ساری دی.

له همدې امله، موږ په جدی توګه پوښتنه کوو: څوک د پاکستاني جنګي مجرمینو ساتنه کوي؟ څوک د هغوی تر شا ولاړ دي؟ ولې له هغوی سره حساب نه کېږي؟ ولې نړیواله ټولنه د پاکستاني جنرالانو او دیکتاتورانو پر جنګي جرمونو باندی سترګې پټوی؟

موږ د دغو پوښتنو روښانه ځوابونه غواړو او د نړیوالې ټولنې له خوا د سمدستي اقدام غوښتنه کوو

To the International Community, the United Nations, and the International Criminal Court in The Hague

Dear Sir or Madam,

With great dismay over the Pakistani airstrikes, we appeal to the international community, the United Nations, and the International Criminal Court in The Hague.
 
According to available reports, further Pakistani bombings of Afghan territory took place during the night of September 21, 2026, including in the provinces of Kunar and Paktika. In an attack in Kunar Province, Noorgul District, three civilians were killed and four other people were injured, including women. In Paktika Province, Barmal District, a residential building and a shop were also destroyed.
 
We condemn in the strongest possible terms this cowardly attack on civilians and civilian facilities and call for an independent, transparent, and comprehensive investigation into these incidents. Those responsible must be held accountable for their war crimes.
 
According to available reports, Pakistan has already violated Afghan airspace at least 14 times and carried out major airstrikes on Afghan territory. In addition, over the past several decades, the Pakistani military has carried out more than 700 cross-border attacks on Afghan territory, using, among other weapons, fighter jets, drones, missiles, mortars, and artillery.
 
In the attacks mentioned above, numerous homes, schools, universities, hospitals, shops, agricultural areas, and other civilian facilities were destroyed or damaged. Numerous innocent people, including infants, children, women, elderly people, pregnant women, and even livestock, lost their lives or were injured. Many attacks took place at night while families were asleep. Women were killed or injured while carrying out everyday activities such as cooking or washing, while children fell victim to attacks while playing. The ongoing attacks have left the population living in fear and insecurity. Many families have been forced to leave their homes and, at times, spend nights outdoors in the rain without adequate shelter.
 
We strongly criticize the fact that the international community — including the United Nations and the International Criminal Court — has so far failed to respond to these serious violations of international law and has instead largely ignored them.
 
The International Criminal Tribunal for the former Yugoslavia (ICTY) convicted the Bosnian Serb leaders Radovan Karadžić and General Ratko Mladić of war crimes. Likewise, the Kosovo Specialist Chambers in The Hague convicted former President of Kosovo Hashim Thaçi of war crimes. Furthermore, several individuals have been held accountable before international courts for war crimes committed in African conflicts.
 
Against this background, we ask why Pakistani generals and dictators have so far not been held accountable as war criminals by the International Criminal Court. Although these actors have allegedly been responsible for decades for the suffering and deaths of millions of innocent Afghan people on both sides of the Durand Line, they have to this day not been held accountable. Normally, no person would casually kill millions of ants — yet Pakistani war criminals have, without hesitation, taken the lives of millions of innocent Afghans on both sides of the Durand Line. The scale and brutality of these crimes are unprecedented.
 
We therefore ask urgently: Who is protecting the Pakistani war criminals? Who stands behind them? Why are they being spared? Why does the international community turn a blind eye when it comes to war crimes allegedly committed by Pakistani generals and dictators?
 
We demand clear answers to these questions and immediate action by the international community.
